Hemp plants and marijuana plants are both the same species. Legally, hemp is defined as a cannabis plant that contains 0.3 percent or less THC, while marijuana is a cannabis plant that contains more than 0.3 percent THC. CBD can be derived from both hemp and marijuana plants. So in layman's terms this means that hemp does not contain enough of the chemical that gets you high to get high.
Delta 8- THC is a lot more like the neurotransmitter anandamide. Anandamide, commonly referred to as the bliss molecule, works with the cannabinoid receptors in our brains and bodies to produce a high. This is why Delta 8 is able to get you high even without the THC cyclic tail. Now as to why its legal, the 9th Circuit has held that "delta-8 THC products are lawful under the plain text of the Farm Act."
